I'm with you all in the same boat as not getting my MS Points,
But what has irked me even further was my preorder of Duke Nukem Forever Balls of Steel Edition.
I preordered it back in April, then Fishpond notified that it was sent out, the day before release here. They said I'd get it between monday and wednesday.
"Beauty!", I thought. I'd get the game only a couple of working days after release.
That week, no sign of it. Week later, no sign of it. Finally, yesterday I recieved it. Several weeks late for a preorder. Now I don't know about you, but I presumed pre-order meant I would actually get to play it sometime around it's release. Not weeks later.
I believe along the same lines as you guys, that Fishpond never actually had any stock on site. They simply flagged it with their suppliers, lied to me and said it was sent out, and held off until their suppliers could get a copy to on send.
Since the price I paid for it was $100 of RRP (and it is now $50 more expensive on Fishpond than I paid, yet laughably says it will ship within 5 hours) I think they put it off.
Wierdly enough, the game has a printed Australian rating MA15+, but they have stuck a Restricted 18+ sticker on top. I presume the game is Australian stock, and they have restickered it for New Zealand.
Oh well, I got it in the end. I won't be buying anything from Fishpond ever again though.

just received a delivery from mightyape... so i assume that means nothing is gonna come from fishpond... not happy!
i know there are late deliveries sometimes... so i'll hold my breath until about 3-4pm and then i'll be pissed off

Nothing came in the mail for me.
I have asked for an imediate refund, otherwise I will take it higher.
If they dont reply again (as they haven't to my email 2 days ago) I will raise it for sure.

getting a refund from them can be a nightmare... trust me i had to get one on a pre-order they couldn't fill and it took weeks to get a refund

Also had a ratings sticker pasted on top of the cover obscuring the rating on the slick. Was yours factory sealed? I'm curious to know because mine wasn't and there was no DLC content as promised. |

Oof that sucks. I was lucky with my preorder of LA Noire. I ordered mine from Mariio128, recieved it within several working days of release, with both preorder cases for around $49. And this was from a asian/hong kong site. I can't recommend them enough. Duke Forever was in the Balls of Steel Edition packaging, which wasn't sealed, however the actual game inside the pack was shrinkwrapped. They would have had to have opened the BOS wrapping to swap the sticker, I guess. |

Just sent them an e-mail basically stating that i want a refund. Will see how or if they respond.
I also initiated a paypal dispute, but they have done nothing... i want to escalate it and see what paypal ends up deciding. It would be nice if they agreed with me.... and they should, as i've had no other correspondance with fishpond other than their cut and paste e-mail(s) that they have sent me 3 times giving me a new delivery window (which kept on elapsing with me not receiving my items).

Still no points. They are clearly lying to us in an attempt to stall. The worst part is that I have no idea when they might actually send me my points. I just sent them an email demanding an explanation and threatening to cancel my order and never shop there again. I hope I get a reply that isn't just another template email.

I got a full refund from Paypal today after lodging a complaint with them, I would encourage anyone else who paid by Paypal to do the same.
